1. Introduction

These Terms and Conditions ("T&C") govern the use of the www.drajoo.com application ("the Service") provided by MCK PROPULSE SASU company registered in France ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these T&C. If you disagree with any part of these terms, you may not access the Service.
These Terms of Service (“Terms”, “Terms of Service”) also govern your use of our web pages located at https://app.drajoo.com operated by MCK PROPULSE SASU.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”).

2. Definitions

3. Service Description

3.1 Drajoo.com is an online application offering various subscription plans that provide access to specific features.
3.2 The Service is primarily aimed at parents and teachers but is available to all interested parties.
3.3 Access to the application's features is conditional upon subscribing to a paid plan.

4. User Accounts

4.1 You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account and password.
4.2 You agree to accept responsibility for all activities that occur under your account.
4.3 When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
4.4 You cannot share your account with other users.

5. Subscriptions and Payments

5.1 Subscription prices are displayed in euros and include all applicable taxes.
5.2 Payments are processed via Stripe. By subscribing, you agree to Stripe's terms of service.
5.3 Access to the chosen subscription plan is activated upon confirmation of payment by Stripe.
5.4 Subscriptions automatically renew unless cancelled before the next billing cycle.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or MCK PROPULSE SASU cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting MCK PROPULSE SASU customer support team.

6. Cancellation and Refunds

6.1 You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle.
6.2 No refunds will be issued for unused subscription periods.

7. Intellectual Property Rights

7.1 All content, features, and functionality of the Service are owned by MCK PROPULSE and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. User Obligations

8.1 You agree to use the Service only for lawful purposes and in accordance with these T&C.
8.2 You must not attempt to gain unauthorized access to any part of the Service.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, MCK PROPULSE shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
9.2 Our total liability for any claims under these T&C is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Data Protection and Privacy

10.1 We process personal data in accordance with our Privacy Policy, which is incorporated into these T&C by reference.

11. Modifications to the Service and T&C

11.1 We reserve the right to modify or discontinue the Service at any time without notice.
11.2 We may revise these T&C at any time. The most current version will always be posted on the Service.

12. Governing Law and Jurisdiction

12.1 These T&C are governed by French law. Any disputes arising from or related to these T&C or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.

13. Language

13.1 In the event of any discrepancy between the English version and any translated version of these T&C, the English version shall prevail.

14. Severability

14.1 If any provision of these T&C is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these T&C will otherwise remain in full force and effect.

15. Communication

By creating an Account on our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at contact@drajoo.com.

16. Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.
